A man borrowed a sum of money from the bank. After a year, he spent one-third of the borrowed amount, paid one-third back to the bank, and kept one-third. The question is: Is khums required on the entire borrowed amount, or is there a detailed ruling on this matter? [AR_ID:410]

Peace be upon you.

According to Sayyid Sistani and Sayyid Khamenei:

The amount you borrow as a debt does not require khums unless the principal or its equivalent remains until the end of the year, and it is not part of your expenses, or if it was used as capital for trade, and you have paid installments on it. The amount you have paid in installments is subject to khums.

Note: What has been spent this year and whose installment has not yet been paid, if it was spent on expenses for this year:

Sayyid Sistani: It is a debt for obtaining expenses, and you can exclude its value from your profits that are subject to khums at the end of the khums year.

Sayyid Khamenei: You cannot exclude it from the profits when calculating them unless you intend to pay it shortly after the end of your khums year, within a few days, or if it was spent on expenses after the profit has appeared, then it is permissible to do so.
