I borrowed an amount of money to lend to a brother for buying a house, but he only received the amount after a year. I have been paying installments for a year. Do I have to pay Khums, and what is my obligation in the coming years? [AR_ID:5403]

Peace be upon you and God's mercy and blessings.

Grand Ayatollah Sayyid Khamenei and Grand Ayatollah Sayyid Sistani (may God protect them):

The amount you borrow is not subject to Khums because it is not considered profit.

If you purchase something with this money, it is also not subject to Khums.

However, if you start paying the loan installments from profits earned during the year, and the loan is still outstanding, or its equivalent is available and it is not part of your necessities, or you used the loan as capital for trade, then Khums is due on the amount you paid from the installments.

If you borrowed the money on behalf of someone else and the money remained with you as a trust, then you have no obligation, and the mentioned rulings apply to it, not to you.

May you be successful in all good.
